Terms of Service

These Terms of Service ("Terms") govern your access to and use of Better Workspaces, including our website, API, desktop application, and related services (collectively, the "Service"), operated by Better Workspaces ("Better Workspaces", "we", "us", or "our").
Please read these Terms carefully. By creating an account, checking the agreement box at sign-up, or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
1. Acceptance of terms
By accessing or using the Service, you confirm that:
- You have read and understood these Terms and our Privacy Policy
- You are legally able to enter into a binding agreement
- You will comply with all applicable laws and these Terms
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. Account registration and eligibility
2.1 Creating an account
To use most features, you must register with a valid email address and password. You agree to provide accurate information and keep it up to date.
Email verification is required before you can create or join a workspace. You may sign in before verifying, but certain actions will be restricted until verification is complete.
2.2 Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you may use the Service only with consent and supervision of a parent or legal guardian.
2.3 Account security
You are responsible for:
- Maintaining the confidentiality of your password
- All activity under your account
- Notifying us promptly of unauthorized access
We are not liable for losses arising from unauthorized use of your account where you failed to safeguard your credentials.
2.4 One account per person
You may not create multiple accounts to evade restrictions, bans, or workspace limits (for example, the limit on owned workspaces).
3. The Service
Better Workspaces is a team collaboration platform that provides workspaces, spaces, channels, direct messages, threads, file sharing, boards, canvases, mentions, notifications, and related features. Features may change, and we may add or remove functionality over time.
3.1 Desktop application
We offer an optional desktop app built with Tauri. The desktop app shares the same account and data as the web Service but may store encrypted local copies on your device. Use of the desktop app is subject to these Terms and our Privacy Policy.
3.2 No guaranteed availability
We strive for reliable uptime but do not guarantee uninterrupted or error-free operation. Maintenance, updates, and factors outside our control may cause temporary unavailability.
4. Acceptable use
You agree not to:
- Violate any law or third-party rights
- Harass, threaten, defame, or abuse others
- Post or share unlawful, obscene, hateful, or infringing content
- Upload malware, spam, or content intended to disrupt the Service
- Attempt to gain unauthorized access to accounts, workspaces, or systems
- Scrape, crawl, or reverse engineer the Service except as permitted by law
- Use the Service to send unsolicited commercial messages
- Circumvent security, rate limits, or access controls
- Impersonate another person or misrepresent your affiliation
- Use automated means to create accounts or send messages without permission
We may investigate violations and take action, including content removal, workspace restrictions, account suspension, or permanent bans.
4.1 Platform enforcement
Better Workspaces staff may access internal admin tools (protected separately from product accounts) to operate the platform, enforce policies, and respond to abuse reports, subject to our Privacy Policy.
5. User content
5.1 Your content
You retain ownership of content you submit to the Service ("User Content"), including messages, files, canvas drawings, and board items.
5.2 License you grant us
By submitting User Content, you grant Better Workspaces a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as necessary to operate, provide, and improve the Service — including delivering content to workspace members you authorize, generating notifications, and creating backups.
This license ends when your User Content is deleted from our systems, except for reasonable backup retention and where retention is required by law.
5.3 Responsibility for content
You are solely responsible for User Content you post. We do not endorse User Content and are not obligated to monitor all content, but we may remove content that violates these Terms or applicable law.
5.4 Feedback
If you provide suggestions or feedback about the Service, you grant us the right to use it without restriction or compensation.
6. Workspaces, roles, and administrator responsibilities
6.1 Workspace structure
The Service organizes collaboration into workspaces, teams, spaces, and channels with role-based permissions. Visibility rules (public, team, private, or direct message) determine who can access content.
6.2 Administrator duties
If you are a workspace owner or administrator, you are responsible for:
- Managing membership, invitations, and access appropriately
- Ensuring your workspace's use complies with these Terms and applicable law
- Responding to member concerns about workspace content and access
- Configuring permissions and moderation in line with your organization's policies
We are not responsible for disputes between workspace members or for actions taken by workspace administrators within their permitted roles.
6.3 Invitations and discovery
Workspaces may be joined via invite links, email invitations, join requests, or public discovery (where enabled). You agree not to share invite links publicly if your workspace is intended to be private.
7. Intellectual property
7.1 Our property
The Service, including its software, design, branding, documentation, and underlying technology, is owned by Better Workspaces and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or brand features.
7.2 Restrictions
Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service or included software.
7.3 Copyright complaints
If you believe content on the Service infringes your copyright, contact legal@betterworkspaces.dev with sufficient detail for us to evaluate your claim.
8. Third-party services
The Service integrates with third-party providers (including Cloudflare for hosting and storage and Google Firebase for push notifications). Your use of those services may be subject to their terms. We are not responsible for third-party services outside our control.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be secure, uninterrupted, or free of errors, or that User Content will be preserved without loss.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- BETTER WORKSPACES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Better Workspaces and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
12. Termination
12.1 By you
You may stop using the Service at any time. You may request account deletion by contacting legal@betterworkspaces.dev.
12.2 By us
We may suspend or terminate your access immediately if you violate these Terms, pose a security risk, or if we discontinue the Service. We will make reasonable efforts to notify you when practical.
12.3 Effect of termination
Upon termination, your right to use the Service ends. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
13. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Service shall be resolved in the courts of India, and you consent to their exclusive jurisdiction, except where prohibited by applicable consumer protection law.
14. Changes to these Terms
We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we may provide additional notice (for example, by email or in-app notification). Continued use after changes become effective constitutes acceptance.
If you do not agree to revised Terms, you must stop using the Service.
15. General provisions
- Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Better Workspaces regarding the Service.
- Severability: If any provision is unenforceable, the remaining provisions remain in effect.
- No waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations in connection with a merger or sale.
